HR Policy’s new NLRB Report for the second quarter of 2023 covers significant Board decisions, General Counsel initiatives, and more. The report also features a special article for CHROs on the most pressing NLRB issues HR executives need to know.
While the pace of Board activity was noticeably slower this quarter, there were several key developments of which employers should be aware, since “every significant action taken by the Board and its General Counsel will be to increase union density and to minimize employer voice.” Significant Board actions (and those of its General Counsel) included:
- A stricter test for independent contractor status;
- Restricting employer discipline of employees for using extremely offensive language in the workplace;
- Attempts to prohibit most non-compete agreements; and
